Tcontakto S.A.C. (hereinafter “Tcontakto”) is a private company that provides logistics services in Peru. In this regard, we are committed to maintaining the privacy and protection of information of our prospective clients, clients, suppliers, and collaborators in accordance with Law No. 29733, the Personal Data Protection Law, its Regulations, and supplementary regulations. To this end, we adopt the necessary technical and organizational measures to prevent the loss, misuse, alteration, unauthorized access, and theft of personal data provided by data subjects. Furthermore, Tcontakto guarantees the continuous improvement of these measures. In this context, we declare the following guidelines, which we must clearly and unequivocally communicate to our prospective clients, clients, suppliers, and collaborators when their personal data is collected through any of our channels: the existence of the processing of personal data, the purpose of the collection, and the recipients of the information. Tcontakto, or, where applicable, whoever is responsible for the processing, complies with the guiding principles of personal data protection: Principle of consent: In accordance with the principle of consent, the processing of personal data is lawful when the data subject has given their free, prior, express, informed, and unambiguous consent. Forms of consent that are not directly expressed, such as those that require presuming or assuming the existence of an unexpressed will, are not permitted. Even consent given through other declarations must be expressly and clearly stated. Principle of purpose: In accordance with the principle of purpose, a purpose is considered determined when it has been clearly expressed, without ambiguity, and when the objective of the personal data processing is objectively specified. In the case of personal data banks containing sensitive data, their creation can only be justified if their purpose, in addition to being legitimate, is specific and consistent with the explicit activities or purposes of the data bank owner. Professionals who process personal data, in addition to being limited by the purpose of their services, are obligated to maintain professional secrecy. Principle of quality: In accordance with the principle of quality, the data contained in a personal data bank must accurately reflect reality. Data directly provided by the data subject is presumed to be accurate. Security principle: In accordance with the security principle, the processing of personal data must adopt the necessary security measures to prevent any processing contrary to the Law or its regulations, including alteration, loss, and diversion of information, whether intentional or not, and whether the risks arise from human action or the technical means used.
4. Personal Data Protection Clause
Tcontakto collects your personal information, such as full names, telephone numbers, email addresses, identity documents, and other information necessary to fulfill the purposes detailed below. This information is collected through physical forms, online forms on our website, our call centers, and/or any of our other channels, until the processing purposes are fulfilled or you decide to revoke your consent. Your information will be stored for the time necessary to fulfill the purposes described in the following section, as applicable, in our Personal Data Banks for Prospective Clients, Clients, Suppliers, and/or Employees, which are duly registered in accordance with legal requirements for personal data protection.
5. Purposes
The personal data processed has the following purposes: Prospective Clients: To register and store the personal data of potential clients, interested parties, and former clients for sending offers, promotions, and/or advertising. Clients: To maintain a record of information for all clients. This database is used to send commercial benefits, offers, promotions, and/or advertising, as well as to define commercial strategies, identify trends and consumption patterns, and develop tariff plans, as well as to define attractive offers and promotions for clients. Suppliers: To maintain control of our suppliers’ information; we create information files for each one. These files are updated periodically and are part of our evaluation when deciding to purchase goods or acquire services. Employees: To maintain an up-to-date database of company personnel.
6. Security and Confidentiality
Tcontakto has all the necessary technical, legal, and organizational measures in place to guarantee the security and confidentiality of your personal data. Your personal data will be processed in accordance with the principles of legality, consent, proportionality, quality, security, and other applicable regulations regarding Personal Data Protection, preventing its leakage, dissemination, or any other action that could jeopardize your personal information.
7. Transfer of Personal Data to Third Parties
By providing your consent, you authorize Tcontakto to share the collected personal data with its business partners, who may then use this personal data for the purposes described above, in accordance with this Privacy Policy. You also authorize Tcontakto and its business partners to share the collected personal data with national or foreign companies that operate for Tcontakto and/or its business partners.
